Topic and reciprocity in changes in criminal law

The text addresses the problem of scientific knowledge in criminal law, which is when approaching the concreteness and contingency of practice, in general, and judicial cases, in particular, with a loss of generality and necessity, while their conclusions decrease proportionally in certainty and precision. It proposes the Aristotelian dialectical method as the ideal for this matter, typically contingent and practical, ordered to action to direct it. It is specifically considered the topical. It suggests the special topical consideration of the principle of reciprocity in the changes, both for the methodological approach as for the argumentation and the foundation on the Criminal Law.Downloads
