This paper presents the topics of legality and legitimacy in Xenophon's Political Philosophy, focusing on key passages from Cyropaedia and Memorabilia. To understand the portrait of both concepts the paper addresses the portrait of monarchy extensively described by the Socratic author. The paper proposes that the treatment of legitimacy and legality involves the exception: a category not explicitly mentioned by the author. Thus, Xenophon's thought can be understood as a precedent for contemporary categories of analysis that allow a flexible approach to the study of political-legal systems.
