Abstract

The adversial principle is the pillar of a legal process. Indeed, both the Italian and canonical legislation hinge on the adversial principle and the right of defense, with the ‘person’ being centerstage. Albeit the two legislations diverge in several respects, the points in common seem to prevail, especially when considering their roles vis-Á -vis the civil society and the canonical order, respectively, and the need to promote a healthy/peaceful cooperation between the two.
