Abstract

Despite the similar origin and ideology of Uruguayan and Argentinean Civil Codes and that both legislators clearly rejected the laesio, the evolution of the same in these countries has been very different. While in Argentina the application of the laesio has been admitted since 1940 and expressly regulated in 1968, in Uruguay the discussions about its admissibility continues and the majority doctrine considers that the laesio is not applicable under the Uruguayan legal framework in force
