Abstract

The Civil and Commercial Code of the Nation in Argentina establishes that, in cases of obligations to provide money in a currency other than the Argentine peso, the debtor can discharge the debt by providing the equivalent amount in legal tender currency. However, government restrictions and regulations on access to foreign currency have led to exchange rate disparities. The issue lies in determining this equivalence, as there are multiple exchange rates with significant differences since the enactment of Law 27541, such as the official exchange rate, the "solidarity dollar", the "stock exchange dollar" or MEP, among others. Thus, debtors seek to settle their obligations at the lowest possible exchange rate, while creditors aim for the highest. This study focuses on analyzing the jurisprudence generated on this topic, evaluating which exchange rate has been most considered by second-instance courts and identifying the rationales used in their rulings.
